These Terms of Use (the "Terms") govern your use of the TrySsy mobile application and the website at tryssy.com (together, the "Service"), operated by Mykhailo Bilyi, an individual based in Poland ("we", "us", "our"). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
TrySsy lets you photograph clothing items and outfits and receive AI-generated feedback (scores, ratings, pros and cons, occasion suitability, and a buy/skip recommendation). The output is informational and reflects the AI's interpretation; it is not professional fashion or purchasing advice and may be inaccurate.
2. Eligibility and account
You must be at least 18 years old to use the Service. The Service is not intended for minors. This age requirement reflects both our own policy and the terms of the AI provider we rely on (Google Gemini API). By creating an account, you confirm that you are 18 or older and that the information you provide is accurate.
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us at support@tryssy.com if you suspect unauthorized access.
3. Subscriptions, billing, and auto-renewal
TrySsy offers auto-renewable subscriptions. Subscription details (price, duration, included features) are shown on the in-app paywall before purchase.
- Payment. Payment is charged to your Apple ID at confirmation of purchase.
- Auto-renewal. Your subscription automatically renews at the end of each billing period for the same duration and price unless you cancel at least 24 hours before the renewal date. The renewal charge is billed within 24 hours of the period end.
- How to cancel. Manage and cancel your subscription in Settings → [your name] → Subscriptions on your iOS device. Deleting the app does not cancel the subscription.
- Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable. The trial automatically converts to a paid subscription unless cancelled at least 24 hours before it ends.
- Refunds. Purchases through the App Store are subject to Apple's refund policy. We cannot issue refunds for App Store purchases ourselves; please contact Apple. Statutory consumer rights (e.g., the EU 14-day withdrawal right) are unaffected where they apply.
- Price changes. If we change the subscription price, we will notify you in advance. The new price applies to the next renewal after the notice period; you can cancel before it takes effect.
4. Your content
You retain ownership of the photos you upload ("Your Content"). You grant us a worldwide, royalty-free, non-exclusive license to host, process, and display Your Content solely to provide and improve the Service (e.g., to run AI evaluation, store your scan history, and let you share scans). This license ends when you delete the content or your account, except for backup copies that are deleted on our standard rotation.
You confirm that you have the right to upload Your Content and that it does not violate the rights of others or any law.
5. Acceptable use
You agree not to:
- Upload nudity, sexual content, violent or hateful imagery, or content involving minors.
- Upload photos of other people without their consent.
- Reverse-engineer, decompile, or attempt to extract source code from the app, except where allowed by law.
- Use the Service to build a competing product or train another AI model.
- Abuse, overload, or attempt to disrupt our infrastructure (e.g., scraping, DoS).
- Misrepresent yourself or use the Service to violate any law.
We may suspend or terminate accounts that violate these rules.
6. AI output disclaimer
AI-generated scores, recommendations, and text are produced by automated systems and may be wrong, incomplete, or unsuitable for your specific situation. They are for entertainment and informational purposes only. Decisions you make based on the output are your own. We are not liable for purchasing, styling, or other decisions you take based on the Service.
7. Intellectual property
The Service, including its software, design, branding, and content (excluding Your Content), is owned by Mykhailo Bilyi and protected by intellectual-property law. We grant you a limited, personal, non-transferable, non-exclusive license to use the app for your personal use, subject to these Terms.
8. Third-party services
The Service relies on third-party providers (Apple, Firebase, Google Gemini API, RevenueCat, Amazon Web Services). Their terms and privacy policies apply to your interaction with them through our Service. We are not responsible for third-party services or content.
9. Termination
You can stop using the Service and delete your account at any time from Profile → Delete Account in the app.
We may suspend or terminate your access immediately, with or without prior notice, if we reasonably determine that you have violated these Terms or applicable law. For-cause termination does not entitle you to a refund. We may retain account data for a reasonable period after termination to comply with legal obligations or to investigate the violation.
We may also discontinue the Service in whole or in part. If we discontinue it entirely, we will give you reasonable advance notice and an opportunity to export your data. Refunds for active paid subscriptions are handled by Apple under their terms; statutory consumer rights apply where mandatory.
Termination does not refund pre-paid subscription periods, except where required by law or stated above.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.
While we make best-effort backups of your scan history and photos, we do not guarantee that they will be permanently retained or recoverable in the event of system failure. We recommend that you keep original copies of any photos you consider important.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim connected to the Service is limited to the amount you paid us in the 12 months before the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., consumer rights in your country).
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your infringement of third-party rights.
13. Apple End User License Agreement
If you obtained the app from the Apple App Store, the following also applies:
- These Terms are between you and Mykhailo Bilyi, not Apple. Apple is not responsible for the app or its content.
- The license granted is non-transferable and limited to use on Apple-branded products you own or control.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the extent permitted by law, Apple has no other warranty obligation.
- Mykhailo Bilyi, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal-compliance, and consumer-protection claims, and any third-party intellectual-property infringement claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced in the app or by email and take effect on the date specified in the notice. Continued use of the Service after that date constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules. Disputes will be resolved in the competent courts of Poland. If you are a consumer, you may also bring proceedings in the courts of your country of residence, and mandatory consumer-protection rules of your country apply regardless.
